Terms and conditions

These General Terms and Conditions of Sale shall govern the offer and sale of Products, as hereinafter defined, on the website www.cantonishop.com carried out by CANTONI TRADING S.r.l., with registered office in Rovereta, San Marino Republic, Strada degli Angariari, 25, and headquarters in Via Guardia di Rocca, 10,  enrolled in the Companies' Register of San Marino  under no. 4431 Tax Code COE n. SM20828

GENERAL TERMS
These General Terms and Conditions of Sale apply to the electronic sales, for products listed in "Our online products" section.  Customers can save or print these General Terms. The General Terms and Conditions of Sale may be amended from time to time due to new laws and regulations or other reasons. The new General Terms and Conditions of Sale shall be effective as of the date of publication on cantonishop.com. Please visit this section of the Website on a regular basis to check the publication of the most recent and updated General Terms and Conditions of Sale. Cantoni Trading has the right, at any time, to make changes to information about products displayed on our site, e.g. information about prices, description or the availability of products and we may do so without first giving you notice of the changes. We will not, however, make any changes to the price, availability or description of any product after we have accepted an order to supply the product to you. These General Terms and Conditions of Sale are governed by San Marino law, n. 144,  25 October 2005  
CUSTOMER OFFER
The Products listed are offered for sale only to (a) consumers (according to Legislative Decree no. 206/2005) including any individual who is acting for purposes which are outside his or her trade, business or profession, (b) Registered Companies.  The contract shall be deemed as executed when Cantoni send you a purchase order receipt e-mail, containing a summary of the information related to the Order Form (General Terms and Conditions of Sale, the Products' main characteristics, detailed information on price, terms of payment, return policy and shipping costs). 
PRICES
The prices are stated in Euro and include shipping and delivery costs related to the Country of the consumer. The user's country location is tracked by our system on an IP basis. For shipment in EU, the prices include Custom procedures costs. The product price is always the price indicated in the web store when you place your order.
NOTE WELL: Please note that when you import a product, your Country will ask you to balance the VAT payment (VAT level depends on your Country) at the time of the delivery.
ORDER

To place an order for the purchase of one or more Products, you must fill in the online Order Form (to be considered as a contractual proposal) and send it electronically to the Vendor, with the following options:

  1. If already registered Customer login with your  (username and password)  on  "Registered User" section.
  2. If not Registered User, it is sufficient to fill the form with the required data, necessary for Order procedure. 
It is possible, at any time, to become "Registered User"  with a login process. The contract shall be deemed as executed only when the customer will receive the Cantoni purchase order receipt by e-mail. The purchase order confirmation email contains a summary of the information related to the Order (General Terms and Conditions of Sale, the products' main characteristics, detailed information on price, terms of payment and shipping costs).  Before submitting your Order Form for the purchase of Products, you will be asked to review the Order Form to identify and correct possible input errors (and to print or save a copy of it). Please always refer to the Purchase Order n. for any communication. If purchased products are not available or should require a different than the standard Cantonishop delivery time, you will receive a prompt communication.  
PAYMENT
Accepted payment methods are credit card or Paypal, advanced wire. For security reasons CANTONI TRADING reserves the rights to ask for ID copy of Credit card owner. 
SHIPPING DOCUMENTS
Cantoni will issue the invoice of the purchased products, sending it via e -mail to the subject holder of the Order as soon as receive the payment. If the customer does not receive the invoice within 48 hours ( forty-eight ) from the order confirmation when paying by credit card or Paypal, or 96 hours if paying by bank transfer, please contact us. For the issuance of the documents of sale, will prevail the information provided by the customer . CANTONI TRADING, therefore, reminds the Customer to always check with the greatest attention the accuracy of the information provided.
Shipping of the products
Every shipment is covered with insurance against damage/loss occurred during transport. All Cantoni products are well packed with box, cartons, crates or pallet, depending on the products kind.
Shipping times
Shipping times are:
  1. Italy: 5-10 working days for standard products with no personalization.  7-12 working days from receipt of your logo for personalised products.
  2. Europe UE: 5-10 working days for standard products with no personalization.  7-12 working days from receipt of your logo for personalised products.
  3. Europe extra UE: 5-10 working days for standard products with no personalization.  7-12 working days from receipt of your logo for personalised products.
  4. Extra UE: 5-10 working days for standard products with no personalization.  7-12 working days from receipt of your logo for personalised products. 
Delivery time vary referring to final destinations.
  1. Italy: 2-3 working days
  2. Europe UE: 4-5 working days without prejudice to the delay resulting from any custom check
  3. Extra UE: Because the time for delivery extra UE and worldwide can vary considerably, we can't give any specific timeframe. Once the goods have left our warehouse, the tracking number will be sent by email to the purchaser.
DELIVERY TERMS

CANTONI TRADING utilises express couriers in every Country listed below to the address entered in the order. Goods must be checked at the moment of delivery to make sure they correspond to the items ordered. Any eventual anomalies found at delivery (e.g. interference or damage to the packing, damaged goods, missing items on the waybill, etc.) may be indicated directly on the delivery note in a handwritten comment signed by the customer. The consumer or the customer has to verify the integrity of the packing/parcel. If the goods do not correspond to the ordered products, the customer must promptly notice CANTONI TRADING at the e-mail address reported in "Contacts" or by phone to +348 0549 977527. Deliveries methods are the following, related to different destinations:

Important note: before accepting the goods, check the condition of the packaging in the presence of the courier. If the packaging has suffered any damage and/or knocks or is not intact, please SIGN THE PROOF OF DELIVERY SUBJECT TO INSPECTION for each package and number of packages. This will enable us to submit a claim to the courier. WITHOUT THE SIGNATURE marked subject to inspection, IT WILL NOT BE POSSIBLE TO SUBMIT A CLAIM FOR COMPENSATION. If the courier refuses to allow you to sign subject to inspection, please DO NOT ACCEPT THE GOODS.


  • a) Delivery to Italy: delivery will be accomplished by SDA courier with no appointment at street level, between 8.00 - 19.00 from Monday to Friday. In the case of absence of the consignee, the courier will leave a notice and make the second attempt the day after (if not different accorded). After the second delivery attempt with no effect, the parcel will be stored in the warehouse of the courier waiting for consumer instructions, after 10 days the order will be cancelled, and CANTONI TRADING will refund the amount of the order deducted from the shipping and storing costs. 
  • b) Delivery to EU: delivery will be accomplished by TNT courier or similar at street level, between 8.00 - 19.00 from Monday to Friday. The courier will contact the addressee (by e-mail or phone) when the goods reach Custom to fulfil Custom procedure.  The price includes Custom fees. VAT is not included.  The courier reserves the right to apply handling costs to the shipping: Cantoni is not responsible for these costs, which are the buyer's responsibility.
  • c) Delivery extra EU: delivery will be accomplished by TNT courier or similar at street level, between 8.00 - 19.00 from Monday to Friday. The courier will contact the addressee (by e-mail or phone) when the goods reach Custom to fulfil Custom procedure. The product can be subject to Customs fees, (taxes, duties, processing fees, brokerage fees, etc.) which are a responsibility of the person(s) receiving the order. The courier reserves the right to apply handling costs to the shipping: Cantoni is not responsible for these costs, which are the buyer's responsibility. If within 10 days the order will not be collected by the customer, the order will be cancelled and CANTONI TRADING will refund the amount of the order deducted from the shipping costs.

ORDER CANCELLATION
Cancellation of the order is possible within 24 hours from payment, with no additional costs. CANTONI TRADING will refund the total amount with same payment type utilized by the client. If order cancellation is made after 24 hours, CANTONI TRADING will refund the amount decreased of any expenses (administrative/shipping) already occurred
RETURNS

You may return Products purchased from cantonishop.com, without any penalty and without specifying the reason, within fourteen (14) working days from the date of receipt of the Products purchased on cantonishop.com.

Returns are allowed only if you have not requested personalizations services such as logo printing on the product.

To return Products we invite you to send an e-mail to info@cantonionline.com before shipping your return package to us, to receive the return code. It is necessary to return the Products to the Vendor by giving them back to the courier within twenty (20) days from the date on which you have received the Products.
Please note that you will be responsible for all returning costs and charges and also for all risks for loss or damages of the Products.

The return right - besides compliance with the terms and procedures described above - shall be deemed correctly exercised once the following conditions have been fully met:

Fill in and submit the Return Form within fourteen (14) working days from the receipt of the Products purchased on cantonishop.com with a registered letter addressed to CANTONI TRADING S.r.l Via Guardia di Rocca,10 47899 Repubblica San Marino (RSM). The return right may also be exercised within the same time frame by sending an e-mail to info@cantonionline.com and confirmed by registered letter to be sent within the following forty eight (48) hours;

The Products must be returned, complete in their original packaging;

Returned Products must be shipped back to the Vendor with a sole despatch within twenty (20) days from the date of receipt of the Products. Seller shall not accept Products purchased with the same order returned and shipped back according to different despatches.

If the return right is exercised in compliance with the provisions set in this section, the Vendor shall refund the amounts paid for the returned Products. The Vendor shall refund amounts already paid as soon as possible and in any case within thirty (30) days from the date on which the Vendor becomes aware of your decision to exercise your return right. After having confirmed that the terms and conditions stated above have been duly complied with, the Vendor will promptly start the refund procedure

In the event that your return does not comply with the terms and conditions set, you will not be entitled to any refund of sums already paid to the Vendor; nevertheless, you shall be entitled, at your own expense, to receive the products in the conditions in which they were sent back to the Vendor. If you do not wish to receive the products in the conditions in which they were sent back to the Vendor, the Vendor shall be entitled to keep the products and withhold the sums already received

Refund Times and Procedures

After the Products have been returned, the Vendor shall check the conformity of the Products with the conditions indicated above. When the Vendor can confirm that such conditions have been met, the Vendor shall send you an e-mail confirming the acceptance of the returned Products.

Whatever payment type you used, the refund procedure shall be started by the Vendor within thirty (30) days from when the Vendor was informed of your decision to exercise your return right, after checking that the return right has been correctly exercised and that the returned Products have been accepted.

RIGHT OF WITHDRAWAL
Cantoni Trading is located in the territory of San Marino Republic. The company is not therefore subject to the European Consumer code but to the San Marino Republic one, as noted in the art. 1 of these Sales Conditions. Anyhow, to further protect its own online customers, Cantoni Trading still adheres to the Italian Consumer Code because of its higher safety for consumers.The rules and procedures applicable to the right of withdrawal set out here are therefore a reference to the Italian Legislative Decree 21/2014 transposing the European Directive 2011 / 837UE legislation on the Rights of Consumers and are valid only and exclusively for online purchases on CANTONISHOP website. If the customer is a "consumer" as defined in the Article 3 of the Italian Consumer Code, he has the rights stated under the Art. 64 of the Italian Consumer Code and therefore has the right to terminate the Purchase Agreement (the "Withdrawal Right") for any reason, without explanation and without penalty, in the manner set out below. The withdrawal can be asked for the complete order (total withdrawal) or for only a part of the purchased Products(Partial Withdrawal). The right of withdrawal can be exercised by sending, within 14 (fourteen) working days from the receipt of the products, a notice by (international) registered mail to CANTONI TRADING S.r.l Via Guardia di Rocca 10, 47899 Republic of San Marino (RSM). The communication can be anticipated - within the same period - by e-mail (at info@cantonionline.com).The notice of withdrawal must specify the intention to withdraw from the purchase and the product or products for which the customer intends to exercise the right of withdrawal, enclosing a copy of the purchase invoice and the transport document (DDT). After the just mentioned proper completion of the withdrawal procedures and as indicated in the Consumer Code, Article. 64, CANTONI TRADING will send to the customer his/her Number of Practice. This number must be specified by the customer upon return of the / the product/s.The Return of the product/s has to be done within twenty (20) calendar days from the date of receipt of the goods.CANTONI TRADING reminds its customers that the transportation costs for returning the goods are charged to the customer and that the Restitution is under the full responsibility of the customer. CANTONI TRADING, therefore, recommends to its customers, to avoid any damage to the goods, to check carefully, before the shipping, that the goods are intact and inserted, in all their parts (including the ancillary documents) in the complete original packaging. CANTONI TRADING offers to its customers, who make a specific request, a courier service, which will, in any case, be charged to the customer.For any information concerning the shipping costs, you can get in touch with Cantoni using the contacts listed in the "Contact Us" section of the cantonionline.com and cantonishop.com websites. If the right of withdrawal has been properly exercised, CANTONI TRADING will refund the customer the full amount paid for the product covered by the withdrawal, including the expenses of the first delivery, within thirty (30) calendar days from the receipt of the withdrawal request registered mail. The amount will be refunded after deduction of expenses for the Restitution of products. Please note that, according to article 59, paragraph C of the Legislative Decree 21/2014, the consumer may not exercise the right of withdrawal for clearly personalized goods.
GUARANTEES
  • For consumers ( as defined in the art. 3 of the “Codice del Consumo”, D.Lgs 6 Settembre 2005, n. 206):
    all Products available on cantonishop.com are covered by a two years guarantee for defects in conformity (as defined from 128-132 articles) appeared within two years from the date of delivery, as stated in the art. 3 of the Italian Consumer Code (“Codice del Consumo”, D.Lgs 6 Settembre 2005, n. 206).The customer must formally claim the defects within a maximum of 2 months from the date s/he recognized the defect (art. 132, Codice del Consumo).In the case of a lack of conformity, the customer shall be entitled to have the goods brought into conformity free of charge, by repair or replacement or to have an appropriate price reduction or the purchase contract rescinded about those goods. Any claim concerning the warranty related to the ordered items shall be notified by e-mail to the e-mail address: info@cantonionline.com, or by registered mail at Cantoni Trading srl, via Guardia di Rocca 10, Galazzano, RSM.
  • For professional customers:
    all Products available on cantonishop.com are covered by a 12 months guarantee for defects in conformity appeared within one year from the date of delivery. The customer must formally claim the defects within a maximum of 8 days from the date s/he recognized the defect (art. 132, Codice del Consumo).In particular, In the case of a lack of conformity, the customer shall be entitled to have the goods brought into conformity free of charge by repair or replacement or to have an appropriate price reduction or the purchase contract rescinded about those goods. Any claim concerning the warranty related to the ordered items shall be notified by e-mail to the e-mail address info@cantonionline.com, or by registered mail at Cantoni Trading srl, via Guardia di Rocca 10, Galazzano, RSM.

This Privacy Policy is governed by San Marino law and in particular by the Data Protection Code which governs the processing of personal data. The Code ensures that Personal Data are processed by respecting data subjects’ rights, fundamental freedoms and dignity, particularly about confidentiality, personal identity and the right to Personal Data protection.
